Simple Test, Terms and Conditions

As part of its social responsibility, Simple Test inc (together with its affiliates, individually or collectively, “Simple Test” or “Simple Test”) is committed to international compliance with data protection laws. Simple Test adheres to the requirements of the general data protection regulation (gdpr) very seriously. Simple Test takes a principled approach to privacy, security, and compliance, with strong commitments to ensuring you can trust the services you rely on. Simple Test data is hosted in oracle cloud and amazon cloud and we rely on the terms of oracle cloud and amazon web services (aws) gdpr data processing addendum (dpa).

Simple Test obtains, uses, stores and otherwise processes personal, organization and vehicular service data relating to potential current and former workers, contractors, website users and contacts, collectively referred to in this policy as data subjects. When processing data, Simple Test is obliged to fulfil individuals reasonable expectations of privacy by complying with gdpr and other relevant data protection legislation (data protection law).

This policy therefore seeks to ensure that we:

  • Are clear about how data must be processed and the Simple Test expectations for all those who process data on its behalf
  • Comply with the data protection law and with good practice;
  • Comply with the data protection law and with good practice;
  • Protect the Simple Test reputation by ensuring the data entrusted to us is processed in accordance with data subjects’ rights
  • Protect Simple Test from risks of personal data breaches and other breaches of data protection law

The purpose of this Data Protection Policy (“Policy”) is to regulate how Simple Test collects, uses, discloses and retains data. We developed this Policy as part of our ongoing commitment to the protection of your data.

This policy applies to all data we process regardless of the location where that data is stored and regardless of the data subject.

The objectives of this Policy are to:

  • provide a set of privacy and personal data protection standards that govern our procedures and protect the privacy of your data;
  • demonstrate our ongoing commitment to protecting your privacy and addressing any privacy concerns that you might have;
  • describe the ways in which we collect, use, disclose and retain your data;
  • ensure that we comply with the GDPR and Personal Data Protection Act PDPA

4. Data Protection Principles

5. Data Subject’s Rights

Data subjects have rights in relation to the way we handle the data. These include the following rights:

  • Where the legal basis of our processing is Consent, to withdraw that Consent at any time;
  • To ask for access to the data that we hold (see below);
  • To prevent our use of the data for direct marketing purposes
  • To object to our processing of data in limited circumstances
  • To ask us to erase data without delay:
    • if it is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
    • if the only legal basis of processing is Consent and that Consent has been withdrawn and there is no other legal basis on which we can process that personal data;
    • if the data subject objects to our processing where the legal basis is the pursuit of a legitimate interest or the public interest and we can show no overriding legitimate grounds or interest;
    • if the data subject has objected to our processing for direct marketing purposes;
    • if the processing is unlawful.
  • To ask us to rectify inaccurate data or to complete incomplete data;
  • To restrict processing in specific circumstances e.g. where there is a complaint about accuracy;
  • To ask us for a copy of the safeguards under which data is transferred outside;
  • The right not to be subject to decisions based solely on automated processing, including profiling, except where necessary for entering into, or performing, a contract, with Simple Test; it is based on the data subject’s explicit consent and is subject to safeguards; or is authorised by law and is also subject to safeguards;
  • To prevent processing that is likely to cause damage or distress to the data subject or anyone else;
  • To be notified of a data breach which is likely to result in high risk to their rights and freedoms;
  • To make a complaint to the ICO;
  • In limited circumstances, receive or ask for their data to be transferred to a third party in a structured, commonly used and machine readable format

Simple Test must verify the identity of an individual requesting data under any of the rights listed.

6. Consent Obligation

Consent Required

Simple Test shall not collect, use or disclose your personal data unless:

  • You give, or are deemed to give, consent to the collection, use or disclosure of your personal data; or
  • The collection, use or disclosure of your data without your consent is required or authorised under the PDPA or written law.

Provision of Consent

  • Simple Test shall not, as a condition of providing a product or service to you, require you to consent to the collection, use or disclosure of your data beyond what is reasonable to provide the product or service to you.
  • Simple Test shall not obtain or attempt to obtain your consent for collecting, using or disclosing data by providing false or misleading information with respect to the collection, use or disclosure of your data, or use deceptive or misleading practices

Withdrawal of Consent

  • On providing reasonable notice to Simple Test, you may at any time withdraw any consent given, or deemed to be given, in respect of Simple Test’s collection, use or disclosure of your data for any purpose.
  • You may submit the withdrawal of consent via mail, email, or by completing the Withdrawal of Consent Form and submit to Simple Test DPO.
  • On receipt of such notice, Simple Test shall inform you of the likely consequences of withdrawing your consent.

  • Please allow up to 30 days for Simple Test to process and update your request. You may continue to receive marketing messages and other product information from Simple Test within these 30 days.
  • Simple Test shall not prohibit you from withdrawing your consent to the collection, use or disclosure of your personal data.
  • If you withdraw your consent, then Simple Test shall cease (and cause its data intermediaries and agents to cease) collecting, using or disclosing your personal data unless otherwise required under the PDPA or other written law.
  • Although you may have withdrawn consent for the collection, use or disclosure of your personal data, Simple Test may retain your data for purpose of administering your policy with Simple Test and in accordance with Simple Test Records and Retention Policy.

7. Purpose Limitation Obligation

Limitation of Purpose

  • That a reasonable service would consider appropriate in the circumstances; and
  • Where you have been informed in accordance to this Policy, to the extent applicable.

Notification of Purpose

Simple Test shall provide you with the following information whenever we seek to obtain your consent to the collection, use or disclosure of your data, except under circumstances where your consent is deemed or is not required:

  • The purpose(s) for the collection, use or disclosure of your data, on or before collecting your data;
  • Any other purpose(s) for the use of your data of which you have not been informed under this Policy, before the use or disclosure of your data for that purpose; and
  • On request by you, the contact details of the Simple Test Data Protection Officer (“DPO”) who can answer your questions about collection, use or disclosure of your data.

8. Access And Correction Obligation

Access to Your Data

  • On your request, and subject to the restrictions set forth in the PDPA, Simple Test shall, as soon as reasonably possible, provide you with:
    • your data that is in Simple Test’s possession or control; and
    • information about the ways in which your data has or may have been used or disclosed by Simple Test within a year before the request.
  • Simple Test may charge you a minimum fee for access to your data to offset the administrative costs in complying with such requests.

Correction of Your Data

  • You may request Simple Test to correct an error or omission in your data that is under Simple Test’s control or possession. Unless Simple Test is satisfied on a reasonable grounds that a correction should not be made or the law states otherwise, Simple Test shall:
    • correct your personal data as soon as practicable; and
    • send your corrected data to every organisation to which your data was disclosed by Simple Test within a year before the correction was made, unless that other organisation does not need the corrected data for any legal or business purpose.
  • Simple Test is not required to correct or alter an opinion, including professional or an expert opinion

9. Accuracy Obligation

Simple Test shall make reasonable efforts to accurately record your data as given by you or your representatives and make reasonable efforts to ensure that your data is accurate and complete, if the data:

  • Is likely to be used by Simple Test to make a decision that affects you; or
  • Is likely to be disclosed by Simple Test to another organisation

10. Protection obligation

Simple Test shall protect data in its possession or control by making reasonable security managements to prevent unauthorised access, collection, use, disclosing, copying, modification, disposal or any other similar risks.

11. Retention limitation

Simple Test shall cease to retain documents containing your data, or remove the means by which your data can be associated with you, as soon as it is reasonable to assume that:

  • the purpose for which your data was collected is no longer being served by retention of your data; and
  • retention is no longer necessary for legal or business purposes.

13. Complaint handling procedure

  • Should you be unhappy with our treatment of your data or you believe there has been a breach of this Policy, please contact Simple Test’s Data Protection Officer and clearly set out the nature of your concern.
  • Complaints may be initially made orally, or in writing. Where a complaint is made orally, you must confirm the complaint in writing as soon as possible. If you require assistance in lodging your complaint, please contact us.
  • Your complaint will be reviewed and you will be provided with a written response within fourteen (14) working days.

14. Compliance With This Policy

  • Simple Test implements this Policy through the use of proper procedures and staff training to ensure compliance with this Policy.
  • We ensure that our employees and any representatives who deal with your data are aware of the standards of this Policy.
  • Simple Test requires that all of its employees and representatives with access to data maintain confidentiality concerning that data
  • We implement that requirement through appropriate contractual terms and internal policies.
  • Our procedures for handling data are developed to implement the standards of this Policy. Simple Test trains its employees in the proper conduct of those procedures that are relevant to their duties.

15. Review Of Simple Test’s Data Protection Policy

Simple Test ensures that this Policy remains current and continues to fulfil its objectives. This is achieved through periodical reviews, having regards to

  • The need to actively consider privacy and data protection issues as new products and services are developed or offered;
  • Any guidance issued in relation to PDPA; and
  • Any changes to PDPA.

  • Inform you of what personal data we have about you that is under our control;
  • Amend or correct such personal data or any previous privacy preferences you selected, or direct you to applicable tools; and/or
  • Delete such personal data or direct you to applicable tools.
